At the beginning of April, 2022, when Liuhe Branch of Nanjing Public Security Bureau and the Municipal Eco-environmental Law Enforcement Brigade conducted a joint inspection of the motor vehicle inspection station, it was found that a certain inspection station used an electronic device to modify the data of unqualified exhaust vehicles into qualified data and then uploaded it to the environmental protection system server, which made the unqualified vehicles pass the environmental protection inspection. After investigation by the public security organs, it was found that more than one testing station in this city had purchased the equipment. It is of great significance, and the Liuhe District Procuratorate intervened and guided the investigation in advance. After testing the equipment, it is found that the equipment has the function of tampering with some data of the inspected vehicle in transmission.
According to reports, exhaust gas detection is carried out independently by each motor vehicle detection station. After collecting motor vehicle exhaust gas data, the result data is transmitted to the supervision system of the ecological environment department simultaneously. In order to attract car owners to test, motor vehicle inspection agencies try their best to improve the passing rate of testing, which makes criminals find "business opportunities".
Design programs, tamper with data
In order to make the problematic vehicle "go on the road with illness", the criminal suspect Dong Mou and other three people conspired to design a modification program for exhaust gas data, which can tamper with the core data of exhaust gas detection to a qualified value, make it into special equipment and connect it in series in the detection equipment, and control the equipment to run with a remote controller, which is easy to operate.
"This kind of equipment is actually a cheater to modify data. This cheating method will make a large number of false data into the supervision system, which will not only endanger the security of the computer information system of the ecological environment system, but also affect the overall national air pollution control plan." Liang Chonggang, the prosecutor, said.
After the investigation of the case ended, Liuhe Branch of Nanjing Public Security Bureau was transferred to Liuhe District Procuratorate for review and prosecution. After combing the facts of the case and relevant evidence in detail, it is found that the equipment involved has a streamlined production path and sales channels.
Since the second half of 2019, Dong Mou, Wei Mou and Liu Mou have formed a three-person criminal gang to seek illegal benefits. Wei Mou is responsible for designing programs, Liu Mou is responsible for making equipment, testing and maintaining, and Dong Mou is responsible for delivery and collection. The equipment is sold to motor vehicle testing stations all over the country through direct sales or the development of agents. In order to improve the passing rate of vehicle exhaust emission detection, some motor vehicle inspection institutions purchased the equipment and used it. Therefore, the equipment is quite popular in the industry.
Bring a public prosecution and impose a penalty
From 2019 to the incident, Dong and other three people violated the national motor vehicle emission inspection system, producing and selling more than 260 sets of cheating equipment for exhaust data, with a sales amount of more than 700,000 yuan.
On September 2, 2023, Liuhe District Procuratorate filed a public prosecution for the crime of providing intrusion and illegal control of computer information system programs and tools. On November 27, 2023, the court adopted all the accusation opinions of the procuratorate and sentenced three people, including Dong Mou, to three years and two months in prison, and each was fined.
