  Two companies in Beijing were fined for overtime work.

  The Beijing Municipal Bureau of Human Resources and Social Security recently announced to the public the first batch of major labor security violations in 2022. Among them, two companies were fined for illegally extending the working hours of workers.

  Among them, Beijing Century Shuguang Culture Communication Co., Ltd. implemented the standard working hours system. From March to July, 2021, the company arranged for 14 workers, including Li X and Liu xx, to extend their working hours by more than 36 hours per month, and did not guarantee that the workers had at least one day off every week. On November 5, 2021, Xicheng District Human Resources and Social Security Bureau made an administrative penalty decision according to law, giving a warning to the company for illegally extending the working hours of workers, and fined it 7,000 yuan, and ordered the company to stop illegally extending the working hours of workers.

  Yingbin Branch of Beijing Hongjude Catering Service Co., Ltd. implemented the standard working hours system. From April to October, 2021, the company arranged for 44 workers, including He xx and Yang X, to extend their working hours by more than 36 hours per month. On February 16, 2022, the Human Resources and Social Security Bureau of Huairou District made an administrative penalty decision according to law, giving a warning to the company for illegally extending the working hours of workers, and fined it 17,600 yuan, and ordered the company to stop illegally extending the working hours of workers.

  What is the punishment standard for overtime work?

  The two companies were fined mainly for extending their working hours by more than 36 hours per month. This violates the regulation of extending the upper limit of working hours.

  According to the provisions of the labor law, due to the needs of production and operation, the employer may extend the working hours after consultation with the trade unions and laborers, generally not exceeding one hour per day. If it is necessary to extend the working hours for special reasons,Under the condition of ensuring the health of workers, the extended working hours shall not exceed three hours a day, but shall not exceed thirty-six hours a month.

  Eye-to-eye investigation shows that the punishment basis of the above two cases includes the provisions of Article 25 of the Labor Security Supervision Regulations.

  According to Article 25 of the Regulations on Labor Security Supervision, which came into effect on December 1, 2004,If the employing unit violates the laws, regulations or rules of labor security to extend the working hours of laborers, the administrative department of labor security shall give it a warning and order it to make corrections within a time limit, and may calculate and impose a fine according to the standard that the infringed laborers are more than 100 yuan and less than 500 yuan.

  Therefore, the standard for each person to fine 500 yuan is already the top penalty.

  How to report overtime?

  At present, Beijing, Shandong, Anhui, Henan, Guangxi, Qinghai, Hunan, Hubei, Jiangxi and other provinces are focusing on the investigation and rectification of overtime work. If a worker encounters overtime work, how should he report it?

  Among them, the Beijing Municipal Bureau of Human Resources and Social Security said that the 12333 hotline, on-site complaint reporting window, mail, internet and other channels for reporting complaints should be unblocked, and the problems involving overtime work should be accepted and disposed of as soon as possible.

  Previously, in 2021, Sichuan concentrated on carrying out a one-week special law enforcement inspection on overtime work, clarifying that there are many channels for complaints. First, complaints can be reported to the local human resources and social security administrative department by telephone or letter; Second, you can report complaints directly to the reception window of local human resources and social security; Third, workers can report complaints to the official website of the local human resources and social security department; Fourth, it can also be reported to the trade union of the unit, and the trade union will coordinate and solve it first. If it cannot be solved, it will report the complaint to the local human resources and social security department.
