Faced with the high-yield temptation of "new shares in the primary market" and "one-word board limit stocks", Ms. Wang was moved and rushed into the platform to open an account and transfer money to the private account designated by the other party to "buy stocks". What makes countless "Ms. Wang" step by step "remotely hooked" is a well-organized criminal gang with a clear division of labor. Since 2019, Hu Mou, Zhu Mou (both handled separately) and others have gone to Dubai, United Arab Emirates, set up dens to specialize in telecommunication network fraud crimes, and recruited so-called "lecturers" and "salesmen" from China until Dubai, and "China people cooperated to cheat China people".
The criminal gang adopts the corporate operation mode and is divided into different teams, and its salary income is calculated according to the "fraud KPI". There is a clear division of labor within the team, from the administrative supervisor to the lecturer and salesman. Through introductions or soliciting people, fraudsters are constantly coming here to join in the fraud to escape domestic legal punishment. These people have been engaged in fraud crimes in fraud dens in Dubai, United Arab Emirates for more than 30 days.
Criminal gang fraud steps
They have a highly targeted "financial" fraud model:
First of all, the real-name micro-signals purchased are "numbered" by a special person. The gang has a special WeChat group to contact WeChat "number merchants" and purchase a large number of "numbered" WeChat accounts through the "number merchants" for salesmen to chat with.
After getting the "cultivated" micro-signal, the drainage team left behind in China began to "powder", that is, the victim was "introduced" to the micro-signal of the salesman, and the salesman chatted with the victim according to the written speech and script and gained trust, so as to "fix the powder" next, that is, guide the victim to the webcast room to watch the lecturer’s lecture, and the so-called "lecturer" did not have the qualification to practice financial securities, or even basic financial knowledge.
Next, the lecturer will "drain" the victim to the platform made by the gang, such as Changsheng Capital, Ruida Assets and Huili Assets, by fictional plots with inside information and internal seats, and then seize the opportunity to make the victim unable to withdraw cash, but it becomes their "cash" moment. By the time of the incident, the gang had defrauded many victims, and the total amount of crimes was more than RMB 5 million.
Trial site
After the incident, 21 defendants were either arrested or surrendered themselves. After that, the People’s Procuratorate filed a public prosecution with Songjiang Court for 21 defendants suspected of fraud. During the trial, 21 defendants withdrew part of their illegal income.
After trial, Shanghai Songjiang Court held that eight defendants, including Wang, Fan and Lin, committed telecommunication network fraud against domestic residents abroad for the purpose of illegal possession, and the amount was extremely huge; Defendants Liang and Wu Moumou and other 13 defendants committed telecommunication network fraud against domestic residents abroad for the purpose of illegal possession, and the cumulative time of leaving the country for fraud dens within one year was more than 30 days, which belonged to other serious circumstances and should be investigated for criminal responsibility for fraud.
Twenty-one defendants who played a minor role in the joint crime and were identified as accomplices should all be given a lighter or mitigated punishment. All 21 defendants have confessed or surrendered, and they have withdrawn some illegal gains, and they can all be given a lighter punishment.
According to the facts, nature, plot and the degree of harm to society of each defendant, in order to protect citizens’ property safety, Songjiang court sentenced 21 defendants, including Wang, to commit fraud, and sentenced them to fixed-term imprisonment ranging from 7 years to 1 year and 6 months respectively, and fined them.
